1. Definitions
In these Terms and Conditions:
- Agreement — these Terms and Conditions together with any service quotation or work order issued.
- We / Us / Our — Pelita Kala, operating at 14 Lebuh Pantai, 10300 George Town, Pulau Pinang, Malaysia.
- Client / You — the individual or entity engaging our repair services or using our website.
- Service — any watch repair, maintenance or assessment work carried out by us.
- Watch / Item — the timepiece or related parts deposited with us for service.
2. Acceptance of Terms
By depositing a watch with us for service, submitting an enquiry through our website, or otherwise engaging our services, you agree to be bound by these Terms. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are depositing a watch on behalf of another person, you represent that you have authority to do so.
3. Service Description
We offer three primary repair services: Vintage Dial and Hand Care, Timing Regulation and Accuracy Review, and Battery, Seal and Quartz Health Check. Details of each service, including pricing and typical duration, are described on our Solutions page. All prices are in Malaysian Ringgit (RM) inclusive of applicable taxes.
Services are carried out at our George Town workshop. We do not offer postal repair at this time. Remote enquiries may be accepted at our discretion prior to an in-person assessment.
4. Assessment and Quotation
Where required, an initial bench assessment will be carried out before work commences. The findings will be communicated to you in plain terms, and a quotation provided. No work beyond the agreed scope will be undertaken without your prior approval. There is no charge for an initial look at a piece unless a more detailed bench assessment is agreed in advance.
5. Deposit and Collection of Items
- You are responsible for providing accurate information about the item when depositing it.
- A deposit receipt will be issued for every item left with us.
- Items should be collected within 30 days of notification that work is complete. After 90 days, uncollected items may be treated as abandoned property subject to Malaysian law.
- We will make reasonable efforts to contact you using the details provided.
6. Payment Terms
Payment is due on collection of the item. We accept cash, bank transfer (FPX), and major debit and credit cards. No deposit is required for standard services unless parts must be sourced in advance, in which case this will be discussed and agreed beforehand. Prices quoted are valid for 30 days from the date of quotation.
7. Limitation of Liability
We will take reasonable care with every item deposited with us. Our liability for loss or damage caused by our negligence shall not exceed the replacement value of the item or the cost of the service, whichever is lower. We are not liable for pre-existing faults that are not related to the agreed service, or for any indirect or consequential loss.
Vintage and antique items are accepted on the basis that pre-existing fragility may affect outcomes. We will describe any such concerns before commencing work.
8. Intellectual Property
All content on the Pelita Kala website — including text, images and the service descriptions — is the property of Pelita Kala. Reproduction without written permission is not permitted. The watch movements and cases we service remain the property of the client at all times.
9. Warranties and Disclaimers
We do not warrant that a service will restore a watch to any particular level of performance beyond what is described in the agreed scope. Watch repair involves inherent uncertainty, particularly with aged or worn movements, and outcomes are presented honestly rather than as commitments. Nothing in these Terms limits liability for personal injury caused by our negligence.
10. Cancellation
You may withdraw an item before work has commenced without charge. Once work has begun, you will be responsible for the cost of the work carried out to the point of withdrawal. If we are unable to complete a service due to circumstances outside our control, we will inform you and return the item in the condition received.
11. Privacy
We process your personal data in accordance with our Privacy Policy and the Personal Data Protection Act 2010 (Malaysia).
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of a dispute, we will first attempt to resolve it through direct communication. If that fails, disputes shall be subject to the jurisdiction of the courts of Pulau Pinang, Malaysia.
13. General Provisions
- Entire agreement. These Terms constitute the full agreement between the parties in relation to any service.
- Severability. If any provision is found unenforceable, the remainder of the Terms remains in effect.
- Waiver. Failure to enforce any provision does not waive the right to enforce it in future.
- Changes. We may update these Terms from time to time. The current version will be posted on this page.
